1. Acceptance of Terms

By accessing and using Hosting Haven (We, HH) services, you agree to and are bound by these Terms of Service. If you do not agree to these terms, do use our services.

2. Service Availability

While we strive for and regularly maintain a 99% uptime, we cannot guarantee uninterrupted access to our services. Scheduled maintenance or unforeseen technical issues may result in downtime.

3. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Users are encouraged to review the terms periodically. Continued use of our services constitutes acceptance of any changes.

4. Free Service Limitations

Our free services are provided as a courtesy and privilege, not an entitlement. Users must adhere to the following limitations:

• Discord verification required: You must link your Discord account at billing.hostinghaven.us/discord.php before your free service order will be accepted
• Limited to one free server per user account
• Resource usage must remain within the allocated limits
• Free servers may have lower priority during high-traffic periods
• Free services may be suspended without notice for abuse or excessive usage
• No guaranteed uptime SLA for free services

5. Free Service Abuse Prevention

To maintain service quality for all users, the following activities are strictly prohibited on free plans:

• Creating multiple accounts to circumvent the one-server limit
• Using automated scripts to create excessive requests
• Running cryptocurrency mining or similar resource-intensive applications
• Hosting illegal content or services that violate our acceptable use policy
• Using free services for commercial purposes without upgrading to a paid plan
• Leaving servers inactive or unused for extended periods (see monitoring policy below)

Staff or Developers of Hosting Haven reserve the right to monitor and terminate any free service that is suspected to be in violation of these terms. Users may appeal terminations by contacting support, but repeated violations may result in a permanent ban of service usage or other punishment at the discretion of Staff.

6. General Use Guidelines

You agree to use Hosting Haven services only for lawful purposes and in accordance with these Terms of Service. Users are strictly prohibited from:

• Violating Discord's Terms of Service while using our services
• Engaging in any activity that disrupts or interferes with the proper functioning of our services
• Abusing the Discord API in ways that rate limit or harm our IPs or infrastructure
• Using our services for illegal activities, such as hosting malicious software or phishing campaigns

7. Prohibited Activities

Users are prohibited from engaging in activities that harm Hosting Haven or its users, including but not limited to:

• Attempting to exploit vulnerabilities in our systems or services
• Overloading our servers with excessive requests or traffic
• Attempting to gain unauthorized access to other users' accounts or data
• Distributing spam, malware, or other harmful content
• Violating intellectual property rights of third parties

8. Compliance with Third-Party Terms

Users must comply with the terms of service of any third-party services they interact with through Hosting Haven, including but not limited to Discord's Terms of Service, game publishers' terms, and any APIs or services integrated with your hosted applications.

9. Refund Eligibility

We offer refunds under the following conditions:

• Refund requests must be made within 48 hours of the initial purchase
• Services must not have been actively used beyond initial setup and testing
• Refunds are only available for the first purchase of a service plan
• Monthly subscriptions are eligible for partial refunds on a pro-rated basis
• Annual subscriptions may be refunded if requested within the first 7 days

10. Non-Refundable Items

The following items are not eligible for refunds:

• Setup fees and one-time configuration charges
• Domain registration fees
• Third-party software licenses
• Services that have been terminated due to Terms of Service violations
• Promotional or discounted pricing plans

11. Refund Process

To request a refund:

• Contact our support team at support@hostinghaven.us
• Provide your account details and reason for the refund request
• Allow 3-5 business days for processing
• Refunds will be issued to the original payment method
• Service access will be terminated upon refund approval

12. Limitation of Liability

Hosting Haven is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services. Users agree to use our services at their own risk. Our maximum liability shall not exceed the amount paid for services in the preceding 12 months.

13. Termination of Service

Hosting Haven reserves the right to suspend or terminate your access to our services at any time, without prior notice, if you violate these Terms of Service or engage in prohibited activities. Upon termination, you will lose access to all services and data associated with your account.
